During the European Commission’s potential revisions to the Market Surveillance Regulation (MSR), including the option of expanding responsibilities for online marketplaces, CME believes policy choices must reflect the specificities of second‑hand trade and the distinct role of classifieds platforms. Any new obligations must also be assessed in light of the existing regulatory framework, notably the Digital Services Act and the General Product Safety Regulation, to avoid overlap, inconsistency, and disproportionate requirements

Our members share concerns regarding proposals that will broaden marketplace responsibilities under the MSR and outline the significant risks such changes could pose for circularity goals, EU‑based companies, and the overall effectiveness of product safety enforcement.

To accomplish this, CME members suggest several recommendations the Commission could consider when reviewing the MSR:

  1. Preserve the balanced regulatory framework, established by the Digital Services Act and the General Product Safety Regulation.
  2. Safeguard second-hand and C2C trade as core contributors to the EU’s circular economy.
  3. Prioritise effective and consistent enforcement of existing rules.
